Icarus Pole Fitness Liability Waiver

Like any sport, pole fitness has its risks. In order to be safe:

1. I acknowledge that there are risks involved in the Exercise.  I fully realise the dangers of participating in the Exercise, and fully assume the risks associated with my participation and my wellbeing and safety during and after the Exercise.  I understand and acknowledge that the Exercise instructors and Icarus Pole Fitness Limited owners and directors provide no warranties regarding my wellbeing and safety.

2. I am in an appropriate physical condition to participate in pole fitness (‘the Exercise’), given the known parameters of the Exercise (such as the length, time, physical demands and environmental context).

3. I have taken medical advice on any pre-existing medical conditions, and confirm that it is medically safe for me to participate in the Exercise.

4. I will participate in the Exercise in a manner that does not endanger either me or others. I agree to follow all reasonable safety instructions provided to me by the Exercise instructors, before, during and after the Exercise.

5. I am participating voluntarily in the Exercise.

6. I consent to receiving medical treatment in the event of illness or injuries suffered during or immediately after the Exercise.

7. I hereby waive, release and discharge Icarus Pole Fitness, its officers, employees, agents, contractors, assigns and successors from and against any and all liability for any loss, damage, injury, expense, demand or cause of action that I may suffer with respect to personal injury, death, damage to or destruction of property, theft or otherwise that may arise as a result of my presence in, upon or about the premises as a consequence of my use of the facilities and equipment for the Exercise or otherwise to the maximum extent permitted by New Zealand law.

8. I acknowledge that I have read this waiver and have been allowed the chance to seek legal advice if I wish, and have either sought advice or decided not to seek advice. I acknowledge that I fully understand the terms of this waiver, and have signed it voluntarily. I confirm that I am over 18 years, or if under 18 years, this waiver has been signed by my legal guardian. I agree that this waiver binds my heirs, next of kin, executors, administrators and successors.

9. The provisions of this Waiver are severable. If any one or more provisions are determined to be illegal or otherwise unenforceable, in whole or in part, the remaining provisions shall nevertheless be binding and enforceable to the fullest extent provided by law.
